Workplace Law Enforcement Inquiries
Workplace Law Enforcement Inquiries could come in the form of a Form I-9 audit, a raid or an effort to detain specific people. This may happen at your venue or housing. Employers should have a written response plan to ensure you are prepared to ensure the safety of Equity members. The employer should hold an Emergency Action Plan (EAP) meeting with Equity members to go over the additional safety and security protocols that will be in place.
If the employer is contacted by the Department of Homeland Security (DHS), Immigration and Customs Enforcement (ICE), the Department of Justice or any other federal, state or local law enforcement for any purpose, Equity requests the employer’s cooperation in promptly notifying the Equity Business Representative or the Equity Field Representative. If law enforcement authorities issue a search and/or arrest warrant, administrative subpoena or other request for documents, including but not limited to a notice to inspect I-9 forms, the employer should share it with Equity to enable Equity to take steps to protect the rights of its members.
